Better Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using Better (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms form a binding agreement between you and ZeusInLabs ("we," "us," "our").

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent that you meet all eligibility requirements and that your use complies with all applicable laws.

3. Description of Service

Better is a wellbeing app that delivers daily affirmations and mindfulness content. The App provides personalized affirmations, reminders, and related wellness features to support your daily routine.

4. Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to update it as needed. You must notify us immediately of any unauthorized use of your account.

5. Subscriptions & Purchases

The App may offer auto-renewing subscriptions. Payment will be charged to your Apple ID account upon confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and cancel subscriptions by accessing your Apple ID account settings. Any unused portion of a free trial period is forfeited upon purchasing a subscription. Prices are clearly displayed before purchase and may change in the future with notice.

6. Refunds

All purchases and subscriptions are processed by Apple via the App Store. Refund requests are handled by Apple in accordance with their policies. To request a refund, visit reportaproblem.apple.com. We do not process refunds directly for App Store transactions.

You agree to use the App only for lawful purposes and in accordance with these Terms. You will not:

The App, including its content, features, design, logos, and code, is owned by ZeusInLabs or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding. You may not reproduce, display, or create derivative works of the App or its content without our prior written permission.

9. User Content

The App does not currently support user-generated content posted publicly. If you submit feedback, suggestions, or ideas, you grant us a non-exclusive, royalty-free, perpetual, and irrevocable license to use them for any purpose without compensation to you.

10. Third-Party Services

The App may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party services. Apple is a third-party beneficiary of these Terms with the right to enforce them in connection with App Store transactions.

11. Termination

We may suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms or engage in conduct that we reasonably believe is harmful to the App, our users, or our business. Upon termination, your right to use the App ceases immediately. Any accrued rights or obligations survive termination.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE AFFIRMATIONS AND CONTENT PROVIDED IN THE APP ARE FOR INSPIRATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE MEDICAL, PSYCHOLOGICAL, OR PROFESSIONAL ADVICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZEUSINLABS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

14. Governing Law & Disputes

These Terms are governed by the laws of France, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through amicable negotiation first. If the dispute cannot be resolved within 30 days, you agree to submit to the exclusive jurisdiction of the courts located in Paris, France. Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. For material changes, we will notify you through the App or by email at least 7 days before the changes take effect. Your continued use of the App after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the App.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
